Proving that one did not consent could divert attention from the aggressor's actions.
Another issue:
Consent can be distorted in unbalanced power relationships (e.g., psychological control, workplace hierarchy, financial dependence…).
What about other countries?

Sweden (2018): adoption of a consent law → increase in complaints and convictions, supported by a major awareness campaign.

A symbolic step forward… but insufficient on its own
This reform sends a clear message:
Sexual acts without consent are rape.
But without deeper change:
- In the judicial system, to support victims and train judges.
- In mindsets, to eradicate rape culture.
- In funding, to ensure effective implementation…
… it will not be enough.
Conclusion: a useful law, but not a magic solution
Good idea: it clarifies the law, brings France into compliance with international standards, and offers better protection to certain victims.
But beware: poor implementation could end up placing more emphasis on the victim rather than the aggressor.
The key?
- More justice
- More prevention
- A cultural change to uproot rape culture
