TERMS AND CONDITIONS OF SALE OF MY SELF KEY (MSK)

Article 1. Identity of the seller
MY SELF KEY (MSK), a simplified joint-stock company with share capital of €1,000.

Article 2. Purpose and scope
These Terms and Conditions of Sale govern all sales concluded on the myselfkey.fr website between MY SELF KEY (MSK) (the "Seller") and any natural person acting for purposes outside their trade or profession (the "Customer").
Placing an order implies full acceptance of these terms, in the version in force on the date of the order. The Seller may amend them at any time; the terms applicable to an order are those accepted when it was confirmed.
Article 3. Products and services
The Seller offers:
- the My Self Key connected keychain: a roughly 140 dB alarm, an SOS button, an emergency QR code and a geolocated alert sent to trusted contacts, working together with the My Self Key mobile application;
- the Safe Kit, which includes the Safe Cup;
- self-defense workshops and prevention talks;
- bundles (Kit, Duo, Trio) combining several of these items.
Essential warning. The My Self Key keychain is a prevention tool. It does not replace a call to the emergency services. It alerts the trusted contacts chosen by the user, not the police or the emergency services. It requires a charged phone, the app installed, and network coverage. In case of danger, call 17 or 112, and 3919 for violence against women in France (or text 114 if you are unable to speak). The alarm and the QR code work without a network.
Photographs and descriptions are as accurate as possible but are not contractually binding. Products are offered subject to available stock and production capacity.
Article 4. Mobile application and related services
The My Self Key mobile application is required to use the connected features of the keychain (alert, geolocation, emergency contacts). It requires a compatible smartphone and a data connection. Some features may require a subscription taken out directly with Apple or Google; in that case those subscriptions are managed and cancelled from the relevant platform account, under its own terms.
Article 5. Prices
Prices are shown in euros (€), inclusive of any applicable taxes. They do not include delivery costs, which are shown before the order is confirmed (see article 9). The applicable price is the one displayed at the time the order is confirmed.
Article 6. Orders
The Customer selects their products, checks the order summary, corrects any errors and then confirms. Confirmation constitutes conclusion of the contract and acceptance of these terms. A summary confirmation is sent by email on a durable medium.
Article 7. Payment
Payment is made online, securely, using the methods offered at checkout (bank card, Shop Pay, PayPal in particular), through the Shopify platform. The full price is charged when the order is placed, including for products sold as pre-orders (see article 8).
Article 8. Pre-orders, delivery date, delay and cancellation
Physical products are sold as pre-orders: they are in production and the price is charged when the order is placed, for deferred delivery.
The estimated delivery date is December 2026. It is repeated on every product page and in the order confirmation email.
The shipping times stated in the Shipping Policy apply only to delivery of the parcel, once the finished products have been received from production.
The Customer may cancel their pre-order at any time until dispatch, by simple email to contact@myselfkey.fr, and obtain a full refund of the sums paid (price and delivery costs) no later than fourteen (14) days after the Seller receives the request.
If the estimated date is postponed, the Seller will inform the Customer by email. The Customer may then accept the new date or cancel their order and be refunded in full on the same terms.
In accordance with articles L.216-2 to L.216-6 of the French Consumer Code, if the Seller fails to deliver by the stated date, the Customer may require the Seller, in writing, to deliver within a reasonable additional period. If that period passes without delivery, the Customer may terminate the contract; the Seller will then refund all sums paid no later than fourteen (14) days after termination.
Article 9. Delivery and shipping costs
Products are delivered to the address given by the Customer when ordering. Exact delivery costs are displayed before payment is confirmed.
Delivery is free within mainland France for the Kit, Duo and Trio bundles. For the keychain sold on its own, shipping costs apply and are displayed before the order is confirmed.
For deliveries outside the European Union, customs duties and import taxes may be charged on arrival; these remain payable by the Customer.
Risk passes when the product is physically handed over to the Customer. If a parcel is damaged or lost, the Customer should contact contact@myselfkey.fr: the Seller is responsible for delivery up to the point the product is handed over.
Article 10. Right of withdrawal
The Customer has fourteen (14) days to withdraw, without giving a reason, from the day on which the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods (or of the last item where several items are delivered separately). For services, this period runs from the conclusion of the contract.
To exercise this right, the Customer notifies their decision by an unambiguous statement: email to contact@myselfkey.fr, or letter to MY SELF KEY, 63 bis rue de Sèvres, 92100 Boulogne-Billancourt, France. The Customer may use the model form set out in the annex to these terms, but is not required to do so.
The direct cost of returning the product is payable by the Customer. It depends on the weight of the parcel and the carrier chosen; as a guide, allow between €5 and €10 from mainland France.
The Customer may handle and try the product as they could have done in a shop. Only a loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the goods may be deducted from the refund.
The Seller refunds all sums paid, including standard outbound delivery costs, no later than fourteen (14) days after receiving the decision to withdraw, using the same payment method as the order. The Seller may withhold the refund until the goods have been received back, or until the Customer provides proof of dispatch, whichever comes first.
Exceptions. In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content not supplied on a tangible medium where performance has begun after the Customer's prior express agreement and express waiver of that right, nor to leisure services supplied on a specific date (in-person workshops). For the latter, cancellation terms are set out in article 11.
Article 11. Workshops and talks
Self-defence workshops and talks are provided on an agreed date and at an agreed location. Unless stated otherwise at the time of booking, the Customer may cancel free of charge up to seven (7) days before the scheduled date; after that, the service remains payable. If the Seller cancels or postpones, the Customer is offered a new date or a full refund.
Article 12. Legal guarantees
Notice required by article D.211-2 of the French Consumer Code.
The consumer has a period of two years from delivery of the goods to obtain the benefit of the legal guarantee of conformity in the event of a lack of conformity appearing. During that period, the consumer need only establish the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity requires the trader, where applicable, to supply all updates necessary to maintain the conformity of the goods.
The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.
If the consumer requests repair but the seller insists on replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and be refunded in full against return of the goods, if:
1. The trader refuses to repair or replace the goods;
2. Repair or replacement takes place after a period of thirty days;
3. Repair or replacement causes major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
4. The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious as to justify immediate price reduction or termination. In that case the consumer is not required to request repair or replacement first.
The consumer is not entitled to terminate the sale where the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights set out above arise from the application of articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who obstructs the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L.241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. That guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
To invoke either guarantee, the Customer should contact contact@myselfkey.fr. Nothing in these terms reduces or excludes these legal guarantees.
Article 13. Liability
The Seller is liable as of right for the proper performance of the distance contract, in the circumstances set out in article L.221-15 of the French Consumer Code.
The Seller cannot, however, be held liable for non-performance in the event of force majeure, an unforeseeable and insurmountable act of a third party, or fault on the part of the Customer. Given the nature of the product described in article 3, the Seller does not guarantee that an alert will reach its destination in all circumstances, as this depends on external factors (battery charge, network coverage, availability of the designated contacts). Nothing in this article limits the Seller's liability in the event of personal injury, gross negligence or wilful misconduct.
Article 14. Personal data
The Customer's personal data is processed by MY SELF KEY (MSK), as controller, for order management, delivery, invoicing, customer service and, subject to the Customer's consent, sending commercial communications.
The Customer has rights of access, rectification, erasure, restriction, objection and portability, as well as the right to give instructions about what happens to their data after their death. These rights can be exercised at contact@myselfkey.fr. The Customer may lodge a complaint with the French Data Protection Authority, the CNIL (www.cnil.fr).

Article 15. Customer service and complaints
Any question or complaint may be sent to contact@myselfkey.fr, or by post to MY SELF KEY, 63 bis rue de Sèvres, 92100 Boulogne-Billancourt, France. The Seller undertakes to reply as soon as possible.
The Seller does not provide telephone support: email is its contact channel, and it undertakes to reply within three (3) working days.
Article 16. Consumer mediation
In accordance with articles L.611-1 et seq. of the French Consumer Code, every consumer has the right to use a consumer ombudsman free of charge with a view to the amicable resolution of a dispute with a trader.
After sending a written complaint to our customer service (contact@myselfkey.fr), and failing a satisfactory reply within two (2) months, the Customer may refer the matter free of charge to the ombudsman covering MY SELF KEY (MSK):

The ombudsman must be contacted within a maximum of one (1) year from the written complaint sent to the trader.
Article 17. Charitable commitment
For every order, part of the amount is donated to charities working against violence towards women. The Customer may also add a voluntary donation, which is passed on in full.
Article 18. Intellectual property
All elements of the site and of the products (trade marks, logos, text, images, software) remain the exclusive property of MY SELF KEY (MSK) or its partners. Any unauthorised reproduction or use is prohibited.
Article 19. Governing law and disputes
These terms are governed by French law. In the event of a dispute, the Customer may choose to bring proceedings before the court of the place where they lived when the contract was concluded or where the harmful event occurred, or before one of the courts having territorial jurisdiction under the French Code of Civil Procedure.
